I see on the recent APC minutes of the Environment Committee, as replicated by Neil on the News page, APC are writing to the police in respect of the possibility of an Alcohol Restriction Area on BG/ Mayflower area of Angmering.
My information may be out of date and I do not know how bad the situation is in that area, but my understanding of the legislation is:-
Arun District Council (ADC) introduced an Alcohol Designated Public Places Order in 2006, within the legislation, ...The Criminal Justice and Police Act 2001.
This provides the Police with the powers to confiscate alcohol from individuals who are causing nuisance, annoyance or anti-social behaviour, as a result of drinking.
This legislation was designed for quite serious and regular problems by individuals drinking in public places, particularly street drinking.
The Order made in 2006, by ADC, relates to the whole of Littlehampton and includes Rustington, East Preston and Ferring. The northern boundary of the designated area is in the main, the A.259 and does not include Angmering.
I notice in the minutes, APC are writing to the police. It is the Local Authority who have primary responsibility for these matters and obtaining the orders, not the police, although of course an order would provide police with additional powers of enforcement.
I would have thought it is ADC, that APC should be writing to, in respect of this matter.
I would think it extremely unlikely that BG/Mayflower area alone, would be designated under such an order.
Perhaps the best and most appropriate course would be for APC to make representation to ADC, for an application to amend and extend the current designated area to include the parish of Angmering, or provide an order specifically for Angmering if that cannot be done, if the situation is considered sufficiently serious.
This would provide the power for the local PCSO to enforce this legislation in any part of our village.
Sorry this is a bit heavy, but I'm sure the drinking problem is an issue to those living in the relevant area.
Other residents may have a different view on this matter.
